1. Acceptance of These Terms and Conditions
These Terms and Conditions apply to the purchase of all goods (“Goods”) from Moksha trading as Mokshatrim, a sole trader business owned and operated by Alison Barlow and based in Beeston, Nottingham, United Kingdom.
References to “we”, “us” and “our” refer to Mokshatrim. References to “you” and “your” refer to the customer.
By placing an order with Mokshatrim, you confirm that you have read, understood and accepted these Terms and Conditions. These Terms and Conditions form a legally binding agreement between Mokshatrim and the customer.
We reserve the right to amend these Terms and Conditions from time to time. Any changes will apply only to orders placed after the revised Terms and Conditions have been published on our website.
Nothing in these Terms and Conditions affects your statutory rights.
2. Description of Goods
We make every reasonable effort to ensure that product descriptions, measurements, photographs and prices are accurate and reflect the Goods as closely as possible.
However, occasional errors may occur, and we reserve the right to correct any inaccuracies.
Product photographs are intended to provide an accurate representation of the Goods but should be regarded as illustrative. The appearance of colours may vary depending on screen settings, device calibration, lighting conditions and individual colour perception.
In particular:

Colours may appear differently on different screens and devices.

Measurements are approximate unless otherwise stated.

Slight variations in width, weave, embroidery, finish, dye lots and cutting may occur.

Handmade, vintage, deadstock and traditionally manufactured products may naturally display individual characteristics.
Colour differences arising solely from screen display, lighting conditions or individual perception do not constitute faults and will not normally be regarded as goods being incorrectly described.
Where colour matching is critical, customers are encouraged to contact us before purchasing.
Such variations do not affect your statutory rights where goods are genuinely faulty, damaged, incorrect or materially different from their description.
3. Product Characteristics and Quality
Mokshatrim specialises in unusual, limited edition, vintage, deadstock and internationally sourced trims, ribbons, fabrics and embellishments.
Many products are handmade or produced using traditional manufacturing methods and may display slight variations or characteristics that form part of their individuality.
Vintage, deadstock and traditionally manufactured products may show slight variations in colour, weave, embroidery, finish, width, cutting, storage marks or other characteristics consistent with their age, origin or manufacturing methods. These features are not normally considered faults.
Some products, particularly traditionally manufactured trims and ribbons, may vary in cutting accuracy, width or finish along their length. This may affect the continuous lengths that can reasonably be supplied.
All items are inspected before despatch. As part of our final quality control process, many trims and ribbons are fully unrolled and wrapped onto kraft card for visual inspection.
If, during this process, we identify defects or quality issues that we do not believe meet our standards, we reserve the right not to supply those sections or, where necessary, to cancel and refund the order in full.
Where possible, we will contact customers if quality issues affect the quantity or continuous lengths available.
Much of our stock is limited and many items are not repeatable.
4. Fibre Content and Materials
Where known, fibre content and material information will be included within product descriptions.
However, many items are vintage, deadstock or sourced in limited quantities, and exact fibre composition may not always be known.
Customers are responsible for satisfying themselves that products are suitable for their intended use.
5. Stock Availability
Much of our stock is limited and many items are not repeatable.
Products may also be offered for sale through other platforms, including eBay. Whilst we endeavour to maintain accurate stock levels across all sales channels, items may occasionally become unavailable or quantities may need to be adjusted following quality checks or sales made elsewhere.
If we are unable to fulfil an order, we will contact you and offer a refund, an alternative product or another mutually acceptable solution.
Replacement stock may not always be available.
6. Ordering and Payment
Placing an order constitutes an offer to purchase goods from Mokshatrim.
A contract is formed when we accept your order and payment has been successfully processed.

Orders will not be processed or despatched until payment has been received.
If we are unable to fulfil an order, we will contact you and offer a refund, an alternative product or another mutually acceptable solution. Replacement stock may not always be available.
7. Lengths, Cut Pieces and Fabric
Products may be sold by the metre, by the piece, by the roll or in other specified quantities.
Where products are sold by the metre, we endeavour to supply continuous lengths wherever possible.
Information regarding available lengths may be provided within individual product listings.
If we are unable to supply an order in one continuous piece, we will often contact customers before despatch wherever practicable.
8. Dispatch and Delivery
Orders received before approximately 12 noon are often despatched on the same working day, although this cannot be guaranteed.
Orders are normally despatched within one working day and are not usually despatched on Saturdays, Sundays or public holidays.

The service selected by the customer will normally be used, although we may upgrade services where necessary to provide appropriate compensation cover.
Delivery times are estimates only unless a guaranteed service has been purchased.
9. International Orders
Mokshatrim ships to many countries worldwide but reserves the right to refuse or restrict shipments to destinations where legal, regulatory or practical requirements cannot reasonably be met.
This may include countries affected by

sanctions

customs restrictions or legal requirements, including those arising from the EU General Product Safety Regulation (GPSR).
Shipping availability may change from time to time.
Customers should refer to our Delivery page for the most up-to-date information.
Customers are solely responsible for any customs duties, import VAT, tariffs, taxes, handling charges, brokerage fees or other charges imposed by their own country or by the carrier. These charges are not included in the purchase price or shipping costs unless expressly stated otherwise.
Mokshatrim accepts no responsibility for delays caused by customs authorities or for additional charges applied after despatch.
Orders to the United States are not generally available through our website due to changing tariff requirements and the disproportionate administrative burden involved in calculating product-specific charges.
In certain circumstances, shipments may be arranged by prior agreement.
10. Customer Responsibilities
Customers are responsible for reading product descriptions, measurements and any care information before purchasing and for ensuring that products are suitable for their intended use.
Where products are incorporated into finished items, whether for personal use or resale, customers are responsible for ensuring that the finished products comply with any applicable laws, regulations and safety requirements.
Customers should also ensure that any local import restrictions, customs requirements or product regulations applicable in their own country are understood and complied with.
11. Ownership and Risk
For consumer purchases, responsibility for goods remains with Mokshatrim until the goods have been delivered to you or to a person identified by you to take possession of them.
Ownership of goods passes to the customer once full payment has been received.
12. Right to Cancel and Returns
If you are purchasing as a consumer within the United Kingdom, you have the right to cancel your order within 14 days of receiving your goods.
You must notify us of your intention to cancel within this period. Once notified, you have a further 14 days to return the goods.
Returned items must be:

Unused
-
Unwashed
-
Uncut
-
In their original condition
-
Suitable for resale
Unless the goods are faulty or not as described, customers are responsible for return postage costs.
As set out in Section 2 (Description of Goods), differences in colour arising solely from screen settings, device calibration, lighting conditions or individual colour perception do not normally constitute faults or goods being incorrectly described.
Customers are strongly advised to obtain proof of postage or an appropriate tracked service when returning items, as Mokshatrim cannot be held responsible for returns that are lost or damaged in transit.
Refunds will be processed once returned goods have been received and inspected to confirm that they are in their original condition and comply with these Terms and Conditions.
Nothing in this section affects your statutory rights as a consumer.
13. Faulty Goods
If an item arrives damaged, faulty or incorrect, please contact us as soon as possible.
Where appropriate, we will offer:

A replacement item;

An alternative product by agreement; or
-
A full refund.
Differences in colour caused by screen settings, lighting conditions or individual colour perception do not constitute faults.
Minor characteristics arising from traditional manufacturing methods, vintage materials or the nature of the product are not normally considered faults.
14. Product Care and Suitability
Many products sold by Mokshatrim are unusual, vintage, deadstock or sourced in limited quantities.
Customers are strongly advised to test washing, ironing, steaming, pressing, glues, adhesives, sewing techniques and other application methods before incorporating products into finished projects.
Where possible, testing should be carried out on a small sample or offcut before working with the entire item.
Damage resulting from unsuitable washing, pressing, ironing, heat, adhesives or other application methods will not normally be considered a fault.
African wax fabrics may soften after washing. This is a normal characteristic of the fabric.
Advice provided by Mokshatrim is offered in good faith and based on experience, but customers remain responsible for determining whether products are suitable for their particular requirements.
15. Advice and Guidance
Any advice, suggestions, tutorials, blog posts, social media content or information provided by Mokshatrim are offered in good faith and based upon our experience.
Such information is intended as general guidance only and should not be regarded as professional, technical, medical or safety advice.
Customers remain responsible for determining whether products and techniques are suitable for their own intended purposes.
16. Specialist Uses
Many products sold by Mokshatrim are intended for dressmaking, craft, textile, jewellery-making, costume and decorative purposes.
Unless specifically stated, products are not tested, certified or guaranteed for:

Protective equipment

Medical applications
-
Safety-critical uses
-
Load-bearing purposes
-
Restraint systems
-
Specialist industrial applications
Customers are responsible for ensuring that products are suitable for their intended use.
17. Business and Commercial Customers
Many Mokshatrim customers are makers, designers and small businesses.
Where products are incorporated into goods for resale or commercial purposes, customers are responsible for ensuring that the finished products comply with any applicable laws, regulations and safety requirements.
Our advice does not remove this responsibility.
18. Safety Information
Products sold by Mokshatrim are not toys unless specifically stated otherwise.
Many products contain:

Sequins
-
Magnetic clasps
-
Jewellery findings
-
Cords
-
Small decorative components
These may present choking hazards and should be kept away from babies, young children and vulnerable individuals.
Magnetic products should not be swallowed and should be used with appropriate caution, particularly by individuals with pacemakers or certain implanted medical devices.
19. Limitation of Liability
Nothing in these Terms and Conditions excludes or limits liability where such exclusion would be unlawful.
Subject to this, Mokshatrim’s total liability in relation to any claim shall not exceed the purchase price of the goods concerned.
We shall not be responsible for indirect or consequential losses arising from the use of products, including losses associated with finished items, commercial activities or business operations, except where required by law.
Nothing in these Terms affects your statutory rights as a consumer.
20. Events Outside Our Control
We shall not be responsible for delays or failures in performance caused by events outside our reasonable control.
These may include, but are not limited to:

Industrial action

Severe weather
-
Fire
-
Flood
-
Natural disasters

Power failures

Network failures

Government action

Other circumstances beyond our reasonable control
21. Entire Agreement
These Terms and Conditions constitute the entire agreement between Mokshatrim and the customer regarding the purchase of goods and supersede any previous understandings or agreements.
Any variation must be agreed in writing.
22. Severability
If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
23. Governing Law
These Terms and Conditions shall be governed by the laws of England and Wales.
Any disputes arising in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of England and Wales.
